Jelly Nudge Terms of Service
These terms are an agreement between you and Fidelio Co., Ltd. ("we", "us") about the game Jelly Nudge (the "app") and this website. Please read them before you play. By installing or using the app, you agree to them.
1. Summary
- The app is free to play. It shows ads and offers optional in-app purchases. You do not need to buy anything to play.
- There is no account and no cloud save. Your progress stays on your device. Permanent items you buy (Remove Ads, Premium Pack) can be restored through Google Play; other progress and unused hints cannot.
- Purchases are made through Google Play. Google Play's terms and refund policies apply, together with the consumer rights you have by law.
- Play fair: do not cheat, tamper with the app, its purchases or ads, or use it to break the law.
- Nothing in these terms takes away the rights you have under the consumer protection laws of the country where you live.
2. About these terms
- Your use of Google Play itself, including payment, is covered by the Google Play Terms of Service. Our Privacy Policy explains what information is processed when you play and why.
- You can reach us at support@fidelio.kr.
- These terms are available in English and in Korean (한국어). The Korean version applies to users in the Republic of Korea, and the English version applies to everyone else, unless the law of your country requires otherwise.
- If you do not agree to these terms, please do not use the app.
3. Who can use the app
- The app is intended for adults aged 18 and over (see our Privacy Policy, section 10).
- If you are under 18, or under the age of majority where you live, use the app and make purchases only with the permission of a parent or legal guardian, who accepts these terms on your behalf.
4. Your license to use the app
- We give you a personal, non-exclusive, non-transferable license to install and use the app on Android devices that you own or control, for your own non-commercial entertainment, in line with these terms and the Google Play Terms of Service.
- The license is free. It lasts until you uninstall the app or it ends under section 9.
5. Free play and ads
- To keep the game free, the app shows ads from Google AdMob: full-screen ads between levels, and rewarded ads that you choose to watch to get a hint.
- Ads are made by third-party advertisers. We do not control the content of each ad, and any offer in an ad is between you and the advertiser. How ad data is processed is explained in our Privacy Policy, sections 2 to 4.
- A rewarded ad gives its reward only when the ad finishes. If no ad is available, no reward is owed (the app may offer a free hint instead).
- Ads need an internet connection. You can play without one.
6. In-app purchases
- The app offers these optional items, sold through Google Play's billing system:
| Item | Type | What you get |
|---|---|---|
| Remove Ads | Permanent | No more full-screen ads between levels. Rewarded ads that you choose to watch for a hint stay available |
| Premium Pack | Permanent | Remove Ads, 40 hints and two jelly skins that come only with this pack. Not offered once ads are removed |
| Hint packs (10 or 40 hints) | Consumable | Hints added to the hint count on your device. A hint is used up when you use it |
- Before you buy, the app and the Google Play payment screen show the item and its price. Google Play processes the payment under its own terms and shows any taxes. We never receive your card or other payment details.
- Some items may not be offered in every country.
- Permanent items are linked to the Google account you used to buy them. If you reinstall the app or move to a new device, open Settings and tap "Restore purchases" while signed in to the same Google account.
- Hints from hint packs are kept on your device with the rest of your progress (section 8). We cannot restore unused hints if you uninstall the app or clear its data, because we have no server that stores them.
- Items have no cash value. They cannot be exchanged for money, sold or transferred, except where the law requires otherwise.
- If an item you paid for is not delivered or does not work as described, contact us with the order number from your Google Play order history. We will deliver it, fix the problem or help you get a refund, as the law requires.
7. Refunds, cancellation and withdrawal
- Refunds are handled by Google Play under its refund policies (https://support.google.com/googleplay/answer/2479637). You can ask for a refund from your Google Play order history. You can also contact us (section 16) with your order number, and we will help.
- If the law of your country gives you a right to cancel (withdraw from) a purchase of digital content, for example 14 days in the EU, the EEA and the UK, you have that right. Because items are delivered right after you buy them, the law may end that right once delivery has begun (in the EU, the EEA and the UK, when you agreed to immediate delivery and acknowledged that you lose the right) or once you have used a consumable item. Where your law lets you cancel the part you have not used yet, you can cancel that part.
- If a minor bought an item without the consent of a parent or legal guardian, the minor or the guardian may be able to cancel the purchase under the law of their country. Please ask Google Play or contact us.
- Nothing in these terms limits the refund rights you have by law.
8. Your game data
- There is no account and no cloud save. Your progress, settings, hints and records are stored only on your device. We cannot see, restore or move them.
- Uninstalling the app or clearing its data deletes them. If Android backup is on, your device may back them up to your own Google account, depending on your device settings.
- Permanent items can be restored through Google Play (section 6).
9. Rules of play
You agree not to: - copy, sell, rent, lend, sublicense or distribute the app or its content, or distribute changed versions of it; - decompile, reverse engineer or disassemble the app, or extract its code or assets, except where the law expressly allows it; - use cheats, mods, bots, automation or exploits, or tamper with the app, its save data, purchases or challenge codes, to get items without paying or to mislead other players; - click ads you are not interested in, create fake ad views or clicks, or otherwise defraud advertisers; - use the app to break the law or to infringe anyone's rights; - remove or change any copyright, trademark or other notice in the app.
If you seriously break these rules, your license under section 4 ends and we may refuse support or purchases connected with the breach, as far as the law allows.
10. Intellectual property, videos and screenshots
- The app and everything in it, including the game design, levels, characters, artwork, sounds, music, text and the Jelly Nudge name and logo, belong to us or our licensors and are protected by intellectual property laws. Apart from the license in section 4, these terms give you no rights to them.
- You may take and share screenshots and gameplay videos, including live streams, and earn money from them through the usual programs of video and streaming platforms, as long as you do not suggest that we endorse you and you do not use our artwork, sounds or music on their own (for example, selling them).
- Open-source software and fonts in the app are provided under their own licenses, which apply to those parts.
- If you send us ideas or feedback, we may use them without owing you anything.
- Google Play is a trademark of Google LLC.
11. Updates, availability and ending the service
- We may update the app to fix bugs, improve it, add or change features, or follow the law and Google Play policies. Updates come through Google Play. Some parts of the app may need the latest version.
- We will not use an update to take away a permanent item you bought, or what it does (for example, Remove Ads), unless the law or a security problem requires it. If that happens, we will tell you and give you the remedies the law provides.
- The app needs a compatible Android device. We cannot promise that it works on every device or Android version.
- We may stop offering the app. If we do, we will announce it on this website and, where possible, in the app at least 30 days in advance. The app is made to work offline, so the copy on your device should keep working as far as technically possible, including permanent items you already bought. Ads and restoring purchases depend on Google Play.
12. Our responsibility for the app
- We make the app with care, but we provide it "as is" and "as available". To the extent the law allows, we do not promise that it will be free of errors, always available, or that data on your device will never be lost.
- If you are a consumer, you have legal rights if the app or a paid item is faulty or not as described (for example, in the EU and the UK, the right to have it fixed, a price reduction or a refund). These terms do not affect those rights.
13. Limitation of liability
- Nothing in these terms excludes or limits our liability where the law does not allow it, including liability for intent and gross negligence, for death or personal injury caused by negligence, for fraud, and under product liability laws.
- Subject to that, and to the extent the law allows:
- we are not liable for losses that were not reasonably foreseeable, or for indirect or consequential losses;
- we are not liable for the loss of game data stored on your device, or for problems caused by your device, your internet connection, Google Play, advertisers or events beyond our reasonable control;
- our total liability to you for all claims about the app is limited to the greater of the amount you paid for in-app purchases in the 12 months before the claim and USD 50 (or the same amount in your currency).
- Where the law of your country (for example Germany) does not allow these limits, we are liable for slight negligence only if we breach an obligation that is essential to these terms, and then only for typical, foreseeable damage.
14. Governing law and disputes
- These terms are governed by the laws of the Republic of Korea. If you are a consumer living in another country, you also keep the protection of the mandatory laws of that country (for example, consumer protection laws in the EU, the UK or Brazil), and they apply where they give you more protection.
- If something goes wrong, please contact us first (section 16). Most problems can be solved quickly.
- The courts of the Republic of Korea have jurisdiction. If you are a consumer, you may also bring a claim in the courts of the country where you live, and where your law requires it, we can bring a claim against you only in those courts.
- Users in Korea may also apply to the Korea Consumer Agency (https://www.kca.go.kr) or the Content Dispute Resolution Committee (https://www.kcdrc.kr).
15. Changes to these terms
- We may change these terms when we change the app or when the law changes. We will post the new terms on this page, and tell you in the app where possible, at least 7 days before they take effect, or at least 30 days before for changes that are less favorable to you.
- Changes will not take away a permanent item you already bought. If you do not agree to the new terms, you can stop using the app and uninstall it. If you keep using the app after the new terms take effect, the new terms apply.
